Parties
A. FASHIONCLASH Foundation, hereinafter referred to as FC.
B. The party receiving this document, hereinafter referred to as the Participant.
Definitions
For the purposes of these Terms & Conditions, the following terms shall have the meaning ascribed to them below:
"FC" refers to the FASHIONCLASH Foundation, the organizer of the Event.
“FCF” refers to FASHIONCLASH Festival 2026, taking place in Maastricht, The Netherlands, from 13 November 2026 to 15 November 2026.
"Event" refers to The CLASH House (TCH) as part of the FASHIONCLASH Festival 2026, taking place in Maastricht, The Netherlands, 14 November 2026. Participating in the Event includes a mandatory trajectory leading up to the Event.
"Participant" refers to the individual or collective (more than 1 person) submitting Work to the Event for consideration.
"Work" refers to the performance created by the Participant for the Event.
“Coach” refers to the professional from FC team that guides the Participant in the trajectory.
“Bootcamp” refers to the day of sessions dedicated to Fashion performance and presentation formats.
“ Concept Application” refers to submitting the online form with the concept of the Work to be presented at the Event, to be considered for final selection of participant after the Bootcamp.
“Development Day” refers to a full day of in-person sessions (at the Event venue) for the development of the Work.
“Theater maker” refers to a student of theater and performative arts from FC network to be matched to the Participant to support in the development of the Work.
“Prize” refers to the jury prize of €2.500, which will be rewarded to one of the Participants of the Event.
1. Context
1.1 TCH is an initiative of FC, organized as part of its annual program and in connection to FCF. TCH includes a Bootcamp, and if selected, a coaching trajectory, for the selected Participant, leading up to the Event presentation.
1.2 TCH follows a process divided into three phases, including coaching, development, production preparation, and the final presentation at FCF.
1.3 The final presentation will take place in Maastricht, The Netherlands, on Saturday 14 November 2026. The exact time and location will be determined by FC.
2. Conditions of Participation
2.1 Submitting an application via the website of FC for the Bootcamp is mandatory to participate. Attending the Bootcamp and submitting a Concept Application is mandatory to be considered for selection.
2.2 By applying to the Open Call, attending the Bootcamp, and submitting the Concept Application, the Participant grants FC permission to consider it for selection. Once submitted, the Concept Application cannot be withdrawn under any circumstances.
2.3. Submission of the Concept Application will only be open for Participants of the Bootcamp.
2.4 FC’s selection decisions are final and non-negotiable. No correspondence will be entertained regarding these decisions. Applying to the Open Call, attending the Bootcamp and submitting a Concept Application does not guarantee participation.
3. Working Method and Meetings
3.1 All fashion makers who are open to experiment with presentation forms and are willing to create a crossover between fashion and performing arts, are invited to apply for the Open Call for the Bootcamp.
3.2 The Event consists of a trajectory of key meetings and milestones outlined below. Attendance by the Participant at key meetings is mandatory. Unjustified absences may affect participation and compensation.
3.3 Additional meetings between Participant, Coach and Theater maker are planned in consultation between both parties.
3.4. FC oversees the production, facilities, and administrative management of the project.
Phase 0: Open Call for Participants (Bootcamp and Concept Application)

Bootcamp: 12 May 2026
Concept Application deadline for the Event: 19 May 2026, 23:59 (CET)
Final selection of 10 participants for Trajectory: 21 May 2026
Online Kick-off meeting: 26 May 2026 (time to be confirmed) - Introduction, explanation of the trajectory, hosted by FC.
Phase 1: Coaching and Development day (June- September 2026)
3.5. Participant receives a minimum of 2 coaching sessions and a maximum of 3 coaching sessions (with FC team). Online coaching sessions are divided in Phase 1 and 2 and can be scheduled in June, September and October respectively.
3.6. FC team will match participants to one Theater maker student, to support the Participant in the Trajectory, and in-person during the Development day.
3.7. FC team will host a Development day, a full day of sessions for the development of the presentation in the Event venue, supported by FC team coaches, the assigned Theater maker and performers. This will occur along with one of the Casting workshops.
3.8. Participant delivers PR materials, including an English-written bio of the Participant and a description of the Work, and a minimum of 5 and a maximum of 10 images for promotional purposes.
3.9. FC organizes casting moments for performers in phase 2. Preferences for performers as part of the Work should be delivered by the Participant.
3.10. Inspiration for hair/make-up as part of the Work should be delivered by the Participant. Final hair & make-up looks will be decided in consultation between FC, Participant and hair/make-up partners of FC, taking inspiration of the Participant into account.
3.11. Important dates
May/June Matching Theatre makers to each Participant of the Event.

Development day: Thursday 10 September 2026 (full day in Maastricht)
Travel costs for the Development day can be reimbursed (see 6.2 for details).
Phase 2: Coaching & Production Preparation (September-November 2026)
3.12. Participant joins an online 1-on-1 (technical) production meeting (± 20 min) for the Work.
3.13 FC organizes casting moments for performers (exact dates and locations to be decided by FC). FC will take preferences as mentioned in 3.9 into account.
3.14. Participant delivers royalty free music, audio and/or video as part of the Work

Deadline for delivery of royalty free music, audio and/or video: Thursday 1 October 2026
Phase 3: Presentation at FCF
3.16. The Work will be presented on Saturday 14 November 2026.
3.17. The duration of the performance for the Event should be max. 5 minutes.
3.18. FC will provide basic technical support (e.g., lighting and sound). Other presentation equipment needed for the Event is to be discussed.
3.19. Participant must be present for fittings on Friday 13 November 2026 afternoon and on Saturday 14 November 2026 for rehearsals, Hair & Make-up throughout the day.
3.20. Travel costs for phase 3 can be reimbursed. FC will take care of your accommodation (2 nights) (see 6.3 and 6.4 for details).
3.21. An online evaluation with FC will take place after the festival, before the end of 2026, exact date + time to be decided by FC.
4. Presentation
4.1. FC is responsible for the overall construction, appearance and design of the Event.
4.2. Participant is obligated to be physically present at the Event.
4.3. Changes to dates and times, as referred to in this article, will not entitle the Participant to cancel their application, either partially or entirely.
4.4. General scheduling and timetabling of the public presentation(s) and press & industry presentation(s) are entirely at the discretion of FC.
4.5. The Participants will share (part of) their performers/models with other Participants during the Event.
4.6. The Participant
is required to discuss any potential
alterations of the Work with FC. Alterations will not always be permitted by FC.
4.7. FC reserves the right to modify or exclude the Work from presentation if deemed necessary for the overall cohesion of the Event.
5. Awards & Prizes
5.1. The Event includes the Meester Koetsier Talent award worth €2.500 for one Participant, decided by an external jury of industry professionals appointed by FC.
5.2. The Prize winner will be announced on November 14th as the closing of the Event.
5.3. In the event of winning prize money, any additional (international) banking fees are the responsibility of Participant.
6. Compensation Fee & Payment
6.1. Participating in the Event is free of charge.
6.2. Travel costs for the Development Day can be reimbursed ( max. €75, receipts required) This reimbursement applies per Participant, whether an individual or a collective.
6.3. Travel costs for Phase 3 can be reimbursed (max. €75, receipts required). This reimbursement applies per Participant, whether an individual or a collective.
6.4. FC is providing hostel accommodation for 2 nights for each Participant. Participants will share a
2-person room with single beds.
6.5. If the Participant cancels their participation after 1 September 2026, they will be liable for any costs incurred, irrespective of the reason.
6.6. Participant receives 2 entrance tickets for guests to visit the Event.
6.7. Participant does not receive entrance tickets to other events or programs as part of FCF.
7. Copyright
7.1. The Work that is developed for the Event is the artistic property of the Participant.
7.2. FC is the proprietor of all intellectual property rights related to the Event, including the FC brand (name), logo(s), and Event image(s).
7.3. FC may grant the Participant the right to use the brand name, logo(s), and/or event image(s) for individual promotional use. In such cases, FC may require that the trademarks and/or images be used solely in the form provided by FC. The Participant may not use these trademarks and/or images for purposes other than promotion and may not distort them in any way.
7.4. In the event of a breach of the conditions outlined in 6.2, the Participant must immediately cease using the trademarks and/or images upon FC’s first request.
7.5. FC reserves the right to use the Participant's intellectual property solely for promotional purposes related to the Event, both during and after the Event.
7.6. This includes the right to distribute such images or clips via digital platforms, social media, press releases, websites, and other promotional channels without additional compensation to the Participant or third parties, unless otherwise agreed in writing.
7.7. By entering the Event, the Participant confirms that they hold all rights and permissions for the Work, including but not limited to rights related to music and design.
7.8. The Participant acknowledges that FC may photograph or film the Event, including the Participant’s presence at the Event, and may use these images and recordings for promotional and archival purposes, including but not limited to marketing materials, websites, and social media.
9. Liability
9.1. FC and its representatives, partners, or sponsors shall not be liable for any direct or indirect damage sustained by the Participant, their staff, or visitors, including but not limited to operational losses, theft, destruction, or damages caused by third parties.
9.2. FC is not liable for indirect and/or consequential damages, including, but not limited to, loss of profits and turnover, regardless of the cause.
9.3. The Participant holds FC harmless against any claims by third parties related to the loss of items, regardless of the cause, as long as the loss was caused by the Participant, their staff, or their visitors.
9.4. The Participant shall indemnify and hold harmless FC from any and all claims, liabilities, damages, and expenses (including but not limited to attorney's fees and court costs) arising from claims involving copyright, trademark, credits, publicity, screening, and loss or damage to the submitted work.
9.5. If the Participant wants insurance for the damages mentioned in this article, they must arrange appropriate insurance coverage for themselves for the duration of the Event.
9.6. If the Participant wishes to ship items to FC headquarters for the Event, they are responsible for any customs taxes and duties on international packages outside the European Union.
9.7. The Participant acknowledges that they are fully responsible for any legal costs arising from a rights dispute involving their Work.
9.8. The Participant warrants that they are authorized to commit their work for presentation and indemnifies and holds harmless FC, its sponsors, associates, affiliates, directors, employees, subcontractors, and consultants from any and all claims, liabilities, losses, damages, and expenses, whether consequential or incidental, arising from copyright or trademark infringement and/or loss or damage of the submitted content.
10. Confidentiality and Code of Conduct
10.1. The Participant agrees to keep any confidential information disclosed by FC or other parties related to the Event confidential and not to share such information with third parties without prior written consent from FC. This includes, but is not limited to, details about the Event, the selection process, sponsors, and any non-public information shared during the Event.
10.2. The Participant agrees to conduct themselves in a professional and respectful manner throughout the Event. This includes, but is not limited to, respecting other participants, attendees, FC staff, and all Event staff, as well as following all guidelines set by FC regarding behavior during the Event. Any Participant who engages in inappropriate behavior or misconduct may be disqualified or removed from the Event at FC’s discretion.
11. Force Majeure
11.1. FC shall not be liable for any failure or delay in performing its obligations under these Terms & Conditions if such failure or delay is due to causes beyond FC's reasonable control, including but not limited to natural disasters, strikes, civil unrest, war, pandemics, or any other unforeseen event of force majeure.
11.2. In the event of force majeure, FC reserves the right to cancel, postpone, or reschedule the Event or to alter the format of the Event. If the Event cannot take place as planned due to force majeure, FC will notify the Participant as soon as possible and will not be held liable for any direct or indirect losses incurred by the Participant as a result of the change or cancellation.
11.3. If the Event is cancelled or significantly altered due to force majeure, the Participant shall have the right to withdraw from the Event, but will not be entitled to a refund of any fees or compensation for costs incurred.
12. Privacy and Data Protection
12.1. By submitting their Work to the Event, the Participant agrees to provide certain personal information to FC, which may include name, contact details, biographical information, and other relevant data.
12.2. FC will process the Participant’s personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Personal data will be used solely for the purpose of organizing and promoting the Event and may be shared with Event partners and sponsors for those purposes.
12.3. Under the GDPR, the Participant has the right to correct, and delete their personal data. The Participant may also withdraw consent at any time, subject to applicable laws. Requests for data correction, or deletion should be submitted to FC at the provided contact details.
12.4. FC will retain the Participant’s personal data only for as long as necessary for the purposes outlined in these Terms & Conditions and in compliance with applicable laws.
13. Subletting
The Participant is not permitted to assign or sublet their participation to third parties without obtaining prior written approval from FC. If the Participant violates this clause, they will be required to pay FC a non-negotiable fine of €2,000.
14. Sponsors
14.1. FC has partner and sponsor relationships with several media outlets and businesses. The Participant is not allowed to make their own sponsorship agreements with companies or organizations regarding their creative work for the Event unless written permission from FC is obtained. FC reserves the right to require the cancellation of any such sponsorship agreements.
14.2. By entering the Event, the Participant assigns all rights, title, and interest in the film and clips to FC, its sponsors, associates, affiliates, directors, employees, subcontractors, and consultants for promotional and advertising purposes related to the Event, in perpetuity and on an irrevocable basis. This may include fulfilling any sponsor-related obligations, subject to the availability of the Participant and the sponsor covering all associated costs, including travel and accommodation.
15. Applicable Law and Jurisdiction
15.1. These Terms & Conditions and any related agreements between FC and the Participant are governed by Dutch law.
15.2. Any disputes arising out of or relating to the agreement between FC and the Participant must exclusively be brought before the competent court in Maastricht, The Netherlands.
16. General Provisions
16.1. These Terms & Conditions constitute the entire agreement between FC and the Participant regarding the Event and supersede all prior agreements or understandings.
16.2. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.3. FC reserves the right to modify these Terms & Conditions at any time. Any changes will be communicated to the Participant in writing, and such changes will become effective upon notice.
